Terms and Conditions

These Terms and Conditions govern access to and use of the AlHerafey website, mobile applications, accounts, booking tools, communications, and related services (collectively, the “Services”). By creating an account, accepting these Terms electronically, or using the Services, you confirm that you have read, understood, and agreed to them.

1. Platform Operator and Contact

The AlHerafey Services are operated under the responsibility of Thair Majed Ghazi Adameh. Questions about these Terms, support matters, or complaints may be sent to support@alherafey.com.

2. Eligibility and Electronic Acceptance

You must have the legal capacity to request or provide the relevant services. Electronic acceptance during registration constitutes agreement to these Terms, and AlHerafey may record the accepted version and acceptance time in accordance with Jordanian Electronic Transactions Law No. 15 of 2015. The Services are not directed to children. You must not create an account using another person’s information without valid authority.

3. Nature of the Platform

AlHerafey is a technology platform that helps customers discover artisans and manage service requests, quotations, bookings, and communications. Unless expressly stated otherwise, the independent artisan - not AlHerafey - performs the professional work. AlHerafey does not guarantee the outcome of every independently performed service. Nothing in these Terms excludes AlHerafey’s responsibility for operating its own Services, protecting personal data, or complying with a mandatory legal duty.

4. Accounts and Security

You must provide accurate, current information, protect your password and devices, and promptly notify support of suspected unauthorized access. You are responsible for activity performed through your account unless it results from a security failure for which AlHerafey is legally responsible. Accounts may not be sold, transferred, impersonated, or used to mislead other users.

5. Artisan Profiles and Verification

An artisan must provide truthful professional information and any license, permit, certificate, image, or document reasonably required for the offered work. Profile verification means that AlHerafey reviewed specified account information; it is not a guarantee of every future act, statement, or service outcome. AlHerafey may review a profile again when information changes or a safety, authenticity, or conduct concern arises.

6. Bookings, Quotations, and Service Scope

Customers should accurately describe the requested service, location, access conditions, and preferred time. Artisans should clearly state the proposed scope, price, timing, and materials where applicable. A rate displayed on a profile is indicative unless a specific quotation is accepted for a booking. Material changes should be documented through the booking or conversation. These Terms do not create an undisclosed cancellation fee, refund promise, or charge not implemented and shown through the Services.

7. Customer and Artisan Responsibilities

Artisans must perform accepted work professionally and safely, respect the customer’s property and privacy, and obtain agreement before adding work or cost. Customers must provide accurate information, reasonable and safe access, and use bookings, ratings, and complaints in good faith. Each party retains all mandatory rights under Jordanian law, including Consumer Protection Law No. 7 of 2017 where applicable.

8. Coins and Payments

The Services may display an operational artisan balance called “coins,” awarded under eligible platform activities and recorded in a transaction history. Administrative redemption may occur under the program rules presented to the artisan. Coins are not a bank deposit, stored-value account, or financial instrument and do not create a cash entitlement outside the published program. If a digital purchase is introduced in the iOS application, the applicable price, entitlement, Apple payment requirements, and purchase terms will be shown before purchase.

9. User Content and Prohibited Conduct

You retain ownership of content you lawfully provide and grant AlHerafey a limited license to host, display, transmit, and process it as needed to operate, verify, support, and protect the Services. Illegal, fraudulent, threatening, abusive, harassing, discriminatory, exploitative, sexually explicit, privacy-infringing, or intellectual-property-infringing content is prohibited. Impersonation, spam, malware, unauthorized access, and publishing another person’s data without a lawful basis are also prohibited.

10. Reporting, Blocking, and Moderation

Users may report a user or content, submit a complaint, block new communications, or contact support. Authorized administrators may review reports, preserve relevant evidence, restrict content or accounts, and take proportionate action. Blocking does not automatically erase booking or conversation records needed to protect participants or resolve an active matter. AlHerafey does not promise continuous pre-screening of every message but responds to reported content through the available procedures.

11. Reviews and Ratings

A review must reflect a genuine booking experience and must not be fraudulent, retaliatory, abusive, or unrelated to the service. AlHerafey may investigate and remove content that violates these Terms while preserving lawful and honest consumer feedback.

12. Privacy

Personal-data processing is governed by the Privacy Policy, Jordanian Personal Data Protection Law No. 24 of 2023, and applicable regulations. Users must not use another participant’s telephone number, address, photographs, messages, or other information beyond the legitimate purpose of the requested service.

13. Cancellation

Current booking cancellation and quotation-rejection options are described in the Cancellation Policy. Cancellation does not extinguish an accrued right, an unresolved complaint, or an applicable legal obligation.

14. Suspension, Termination, and Account Deletion

AlHerafey may proportionately restrict or suspend an account for fraud, safety threats, unlawful conduct, or a material breach. Suspension is different from permanent deletion. Customers and artisans may request deletion through the application or the public Account Deletion page. Deletion does not waive an outstanding financial right or active dispute, and necessary records may be anonymized or access-restricted as described in the Privacy Policy and applicable law.

15. Intellectual Property

The AlHerafey name, logo, visual design, software, and original platform content are protected by applicable law. You may not copy, misuse, reverse engineer, interfere with, or attempt unauthorized access to the Services. User content remains owned by its lawful owner, subject to the limited operational license described above.

16. Third-Party Services

The Services may rely on hosting, email, notification, Apple, Google, or other independently operated services. Your direct use of a third-party service may be subject to its own terms. AlHerafey remains responsible for its selection and use of processors to the extent required by applicable law but is not responsible for independent activity it does not control.

17. Availability and Warranties

AlHerafey works to keep the Services secure and available, but maintenance, faults, network interruption, or circumstances outside reasonable control may occur. The Services are provided subject to all mandatory guarantees and rights that cannot lawfully be excluded, including applicable consumer rights.

18. Responsibility and Liability

Each user is responsible for their own conduct, obligations, and content. AlHerafey is not the performer of independent professional work merely because it enabled discovery or communication. Nothing in these Terms excludes liability for fraud, gross fault, or breach of a mandatory duty where exclusion is prohibited. Responsibility is determined according to the facts and applicable Jordanian law.

19. Apple iOS Application

Unless an approved custom end-user license agreement is presented in App Store Connect, the iOS application is licensed under Apple’s Standard Licensed Application End User License Agreement. Apple is not responsible for operating or supporting AlHerafey’s Services. These Terms and the Privacy Policy continue to govern AlHerafey accounts, bookings, communications, content, and platform operations.

20. Governing Law and Jurisdiction

These Terms are governed by the laws in force in the Hashemite Kingdom of Jordan. Competent Jordanian courts have jurisdiction unless applicable law requires another forum or procedure. Nothing in these Terms waives a mandatory consumer or personal-data right.

21. Changes to These Terms

AlHerafey may update these Terms when the Services, law, operational practices, or app-store requirements change. The revised date will be published here, and renewed acceptance may be requested for a material change or where required by law. Changes will not retroactively remove accrued rights except where lawfully permitted.
